Terms of Service

These Terms of Service (“Terms”) are an agreement between you and DealHero LLC (“DealHero”, “we”, “us”) for use of DealHero at dealheroapp.com and app.dealheroapp.com (the “Service”). If you use the Service for a company, you agree for that company and confirm you can bind it. If you don’t agree, don’t use the Service.

1. Accounts

You must be 18 or older and give accurate information. You are responsible for your login, for everything done under your account, and for the people you invite to your workspace. Tell us right away at [email protected] if you think your account has been accessed without permission.

2. Plans, trials and billing

• New workspaces get a 14-day free trial. No card is needed to start. If you don’t choose a plan, the workspace is paused at the end of the trial; your data is kept and you can export it.
• Plans are billed monthly in advance through Stripe: Solo $49/month (1 user), Team $99/month (up to 5 users), Pro $179/month (10 users included, then $10/month per additional user). Prices may not include taxes.
• Each plan includes the texting and calling allowance shown on our pricing page. Usage above the allowance, extra phone numbers and carrier registration fees are billed at the rates shown there.
• Plan changes are prorated. You can cancel anytime in Settings → Billing; cancellation takes effect at the end of the current billing period and we don’t give refunds for partial months, except where required by law.
• If a payment fails, we will retry and email you. Workspaces with unpaid balances for more than 7 days may be paused.
• We may change prices with at least 30 days’ notice by email. Changes apply from your next billing period.

3. Your content

You own the data you put in the Service (“Your Content”). You give us permission to host, copy, process and display Your Content only as needed to provide and support the Service and as described in our Privacy Policy. You are responsible for Your Content and for having the right to collect and use it, including information about property owners, sellers and buyers.

4. Texting, calling and email

When you send texts, place calls or send email through the Service, you are the sender and you are responsible for following all laws and rules that apply, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the National Do Not Call Registry and state do-not-call laws, CAN-SPAM, carrier and A2P 10DLC requirements, and state call-recording consent laws. In particular, you agree to:

• get any consent the law requires before texting or calling a person, and keep records of it;
• honor opt-out requests (such as STOP) and do-not-contact flags right away;
• not send spam, purchased-list blasts, or messages that are deceptive, harassing or illegal;
• give accurate business information for carrier registration;
• give any notice and get any consent your state requires before recording calls.

Carriers may filter, delay or block messages, and we may suspend texting or calling for accounts that receive complaints or break these rules. You will cover any costs, fines or claims caused by your messages or calls.

5. Acceptable use

You agree not to: break the law or anyone’s rights; use the Service to discriminate in housing or violate fair housing laws; upload malware or try to get into accounts or systems that aren’t yours; scrape, overload or reverse-engineer the Service; resell it without our written permission; or use it to build a competing product.

6. Third-party services

The Service connects to services such as Google, Microsoft, DocuSign, Stripe and Twilio. Your use of those services is governed by their terms. We aren’t responsible for them, and features that depend on them may change if they change.

7. Documents, AI and data

Contract templates, generated documents, comps, ARV estimates, AI suggestions, market data and county records are provided to save you time. They are not legal, tax, appraisal or financial advice and may contain errors. Review everything before you rely on it or send it, and talk to a licensed professional where appropriate. DealHero is not a party to any real estate transaction you make.

8. Availability and changes

We work to keep the Service available and secure, but it may be interrupted for maintenance or reasons outside our control. We may add, change or remove features. If we remove a major paid feature, we’ll tell you in advance.

9. Suspension and termination

You can stop using the Service anytime. We may suspend or end access if you break these Terms, don’t pay, or put others at risk; where reasonable, we’ll give notice first. After your account ends, you can request an export within 30 days, after which we may delete Your Content.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WE DON’T PROMISE THE SERVICE WILL BE ERROR-FREE OR THAT MESSAGES WILL BE DELIVERED.

11. Limitation of liability

TO THE EXTENT ALLOWED BY LAW, DEALHERO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DEALS, OR LOST DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12. Indemnity

You will defend and cover DealHero against claims, fines and costs (including reasonable legal fees) arising from Your Content, your texts, calls and emails, or your breach of these Terms or the law.

13. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules. Any dispute will be handled in the state or federal courts in Maricopa County, Arizona, and you and we consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms. We’ll post the new version here and, for significant changes, email account owners at least 15 days before they take effect. Continuing to use the Service after that means you accept them.
